General Terms and Conditions (GTC)

1. Scope
The following General Terms and Conditions (GTC) apply to all orders placed via our online shop.
Our online shop is primarily aimed at consumers, but occasionally also at businesses.

A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.

2. Contracting parties, conclusion of contract, correction options
The purchase contract is concluded with Yakup Üstün E-Commerce.

By placing the products in the online shop, we make a binding offer to conclude a contract for these products.

You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process.
The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button.
Immediately after submitting your order you will receive a confirmation by email.

3. Contract language and contract text storage
The language available for concluding the contract is German.
We do not store the contract text.

4. Prices and shipping costs
All prices quoted are final prices in euros and include statutory VAT.
In addition to the stated prices, shipping costs may apply, which will be clearly stated during the ordering process.

5. Delivery conditions
We only deliver within Germany.
Delivery will be made to the delivery address specified during the ordering process.
Unfortunately, it is not possible to collect the goods yourself.
Unless otherwise stated, delivery time is approximately 2-5 working days.

6. Terms of payment
The following payment methods are available in our shop:

Prepayment
If you choose to pay in advance, we will provide you with our bank details in a separate email. The goods will be shipped after receipt of payment.

credit card
Your credit card will be charged immediately after your order is completed.

SEPA direct debit
By placing your order, you grant us a SEPA direct debit mandate. We will notify your account of the debit date at least one banking day in advance (prenotification).

PayPal
To pay the invoice amount via PayPal, you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment order. The transaction will be processed immediately after placing your order.

Klarna (instant bank transfer, purchase on account, installment purchase)
Further information can be found during the ordering process or on Klarna’s website.

7. Retention of title
The goods remain our property until full payment has been made.

8. Right of withdrawal
Consumers have the statutory right of withdrawal.
Details can be found in the cancellation policy, which is part of these General Terms and Conditions.

(Note: A separate cancellation policy is required. If you'd like, I can provide it to you immediately.)

9. Warranty and guarantees
9.1 Liability for defects
The statutory liability for defects applies.

9.2 Guarantees
Information on any additional guarantees and their exact terms and conditions can be found with the product and on special information pages in the online shop.

For entrepreneurs, the warranty period for goods delivered by us is 12 months from the transfer of risk.

10. Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/ .

Note: The online dispute resolution (ODR) platform will be permanently discontinued on July 20, 2025. Therefore, the submission of complaints on the platform will cease on March 20, 2025.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships is our registered office.
